The US Supreme Court’s ruling on Murthy v. Missouri is a travesty of justice that hands the federal government unlimited power to deplatform anyone they target. SCOTUS did not directly rule on the merits of the case, but rather decided that the plaintiffs did not have standing. Justice Amy Coney Barrett wrote in the decision, “But they do not point to any specific instance of content moderation that caused them identifiable harm… They have therefore failed to establish an injury that is sufficiently ‘concrete and particularized.’” However, it is impossible for any plaintiff to point to a “specific instance” when they have been deplatformed and are not allowed to post anything. Thus, SCOTUS just created a circular reasoning maze through which no victim of government censorship can successfully navigate. As Jonathan Turley writes, "The Government is engaging in censorship by surrogate... they have made a mockery of the limits of the 1st Amendment." In his opinion, Alito wrote, "The Court...permits the successful campaign of coercion in this case to stand as an attractive model for future officials who want to control what the people say, hear, and think… It was blatantly unconstitutional, and the country may come to regret the Court’s failure to say so."
